What is Mesothelioma?

“Mesothelioma is a cancer that develops in the lining that covers the outer surface of the body’s organs, such as the lungs”.

Pleural mesothelioma is the most common type of mesothelioma, which develops in the lining of the lung. Peritoneal mesothelioma develops in the lining of the stomach, but mesothelioma has also been known to affect the lining of the heart or testicles.

Mesothelioma can take 10 to 50 years (or more) to develop following exposure.

Mesothelioma can be caused by the inhalation of a small amount of asbestos dust and or fibre, which can be through exposure at the workplace or living near an asbestos factory or building. Not only can mesothelioma be caused through the direct inhalation of asbestos dust and fibres, but also through secondary exposure in a domestic setting.

On 31 October 1965, the Sunday Times published an article based on the finding of the paper of Newhouse and Thompson, where it was identified that the risk to a fatal illness can develop from low level of exposure to asbestos both in an occupational and domestic environment.

This is deemed the “watershed” date, the date that employers, companies and corporations knew or ought to have known that there “could be no safe or permissible level of exposure, direct or indirect, to asbestos dust”.

We at James Murray have a vast amount of experience and specialist tracing procedures to identify the original employers and their liability insurer for the time you were exposed to asbestos. Regardless of whether that company has dissolved, merged or changed its name, we will seek the defendant and their insurer who would be responsible to pay the compensation if the claim succeeds.

If you were diagnosed with diffuse mesothelioma on or after 25 July 2012 and your mesothelioma was caused by exposure to asbestos when working in the UK, if you are unable to trace the employer that exposed you to asbestos, or their insurers, and you have not made a civil claim, you may be eligible to make an application under the Diffuse Mesothelioma Payments Scheme. We at James Murray have successfully recovered compensation in this manner.

There is a similar scheme available for those who were exposed to asbestos whilst working in the armed forces.

We will deal with your claim quickly and efficiently, keeping you fully informed of each step of the case.
